NiaBend is proprietary software. Buying a license grants the right to use the program; ownership of it, and of everything that makes it up, remains ours. This page says what that means in practice — including what is yours and stays yours.
1. Who owns the software
NiaBend — source code, executables, installer, interface, icons, texts, documentation, the bend calculation and simulation algorithms and the program's file formats — is owned by NIA SYSTEMS LTDA, CNPJ 69.515.575/0001-43. All rights reserved.
Computer programs are protected as intellectual works by Brazilian Law 9.609/1998 (Software Law) and Law 9.610/1998 (Copyright), in Brazil and in the countries party to the Berne Convention. Protection does not depend on registration.
2. What the license is, and what it isn't
The license is an authorization to use, under the terms of the license agreement. It does not transfer ownership of the software or any part of it, and gives no right to the source code. You acquire the right to use the program on one computer, for the contracted term — not the program.
3. What is not allowed
Without our written authorization, you may not:
- copy the program, beyond the backup copy the law allows licensees;
- decompile, disassemble or reverse engineer the program, or try to obtain the source code by any means;
- modify, translate, adapt or create derivative works of the program;
- rent, lend, sublicense, resell or distribute the program or the license;
- remove, hide or alter copyright, trademark or license notices;
- circumvent, remove or modify the licensing mechanism;
- use the name, logo or material from this site in products, ads or documents as if they were yours, or in a way that suggests affiliation or endorsement.
These prohibitions apply to the extent permitted by law and do not reach your parts and production files, authorized backup copies, the computer transfers provided for in the license agreement, acts the law allows — such as those needed for interoperability — or the open-source components, which follow their own licenses.
The law provides civil and criminal penalties for infringing rights over computer programs (Law 9.609/1998, arts. 12 to 14).
4. What is yours
Everything you produce with the program is yours: the parts you draw, the bend programs you generate for the press brake controller, the reports you export, and your tooling, machine and calibration records. Those files live in the Documents\NiaBend folder on your own computer (in the demo version, Documents\NiaBend Demo), never pass through our servers, and remain yours after the license ends.
5. Trademark
The NiaBend name, logo and visual identity are trademarks of NIA SYSTEMS LTDA. The NiaBend trademark application is filed with INPI, Brazil's industrial property office, under process no. 945523963. You may mention the name to say you use the program; you may not use the trademark in a way that suggests the product is yours or that we endorse yours.
6. Content of this site
The texts, images, illustrations, animations and code of this site are also protected and may not be reproduced without authorization. The Inter and JetBrains Mono fonts are third-party and used under the SIL Open Font License.
7. Third-party components
The program uses open-source libraries, each with its own license, which applies only to it — not to NiaBend. The list is in section 8 of the license agreement.
8. Misuse
If you know of unauthorized copying, sale or distribution of NiaBend, or misuse of the trademark, write to [email protected] or through the contact form.
